By accessing or using NotionPulse ("Service"), operated by NotionPulse ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and NotionPulse. We reserve the right to modify these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of the updated Terms.

2. Description of Service

NotionPulse provides an analytics and feedback collection service designed for Notion pages. Our Service allows you to:

  • Track page views and visitor statistics
  • Collect feedback through embeddable widgets
  • View analytics and insights through our dashboard
  • Manage multiple Notion pages from one account

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice to you.

3. User Accounts and Registration

3.1 Account Creation

To use our Service, you must:

  • Be at least 16 years of age
  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Accept all terms of this agreement

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

NotionPulse cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3.3 Account Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Abuse of our Service or systems

4. User Responsibilities and Conduct

By using our Service, you agree NOT to:

  • Use the Service for any illegal purpose
  • Violate any international, federal, provincial, or local laws
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • Submit false or misleading information
  • Upload viruses or malicious code
  • Spam, phish, pharm, pretext, spider, crawl, or scrape
  • Interfere with or disrupt the Service or servers

You retain ownership of any content you submit to our Service, including your Notion page URLs and associated data. By submitting content, you grant us a license to use, process, and store such content for the purpose of providing our Service.

7. Paid Services and Billing

7.1 Free Plan

We offer a free plan with limited features. The free plan is provided "as is" and may be modified or discontinued at any time.

7.2 Paid Plans

For paid plans:

  • Fees are charged in advance on a recurring basis
  • You authorize us to charge your payment method
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice

7.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. You will not receive a refund for any partial billing period.

8. Termination

8.1 By You

You may terminate these Terms and discontinue using the Service at any time by deleting your account.

8.2 By Us

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including but not limited to:

  • Breach of these Terms
  • Violation of our policies
  • Fraudulent or illegal activity
  • Extended period of inactivity

Upon termination, your right to use the Service will immediately cease.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTIONPULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, revenue, profits, or business opportunities
  • Loss of or damage to your reputation
  • Cost of procurement of substitute goods or services
  • Unauthorized access to or alteration of your transmissions or data

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

You agree to defend, indemnify, and hold harmless NotionPulse and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use of and access to the Service
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including but not limited to any copyright, property, or privacy right
  • Any claim that your use of the Service caused damage to a third party

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.

12.2 Arbitration

Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and NotionPulse regarding the Service.

13.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.3 Severability

If any provision of these Terms is held to be unenforceable, that provision will be removed and the remaining provisions will remain in full force.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may freely assign these Terms.
